Pensions Ombudsman Focus June and July 2019 edition

Welcome to the Pensions Ombudsman Focus for the period of June and July 2019. In this edition, we cover six recent complaints to the Pensions Ombudsman, including:

  • A decision by Anthony Arter, the Pensions Ombudsman (the “PO”), to uphold a complaint by a number of scheme members about negligence, maladministration  and possible fraud of the scheme’s Trustees in managing investments;
  • A decision about an application for NHS permanent injury benefits.  The complaint was not upheld.
  • A decision by Karen Johnston, the Deputy Pensions Ombudsman (the “DPO”), to uphold, in part, a complaint from a member about his transfer value. Despite finding that the scheme administrator was not responsible for the delays, the DPO still directed them to pay compensation to the member for distress and inconvenience in failing to keep the member informed about the possible effect of a buy-out.

If you would like to discuss any of the points raised in these determinations, or any other contentious issues you may have, please contact our Pensions Dispute Resolution Group. Our details are shown below.
